1. Agreement to Terms
By accessing our website and utilizing our software development, design, and consulting services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
2. Intellectual Property Rights
All source code, design assets, and documentation created by QubarTech during the project remain the intellectual property of QubarTech until full payment is received. Upon final payment, the intellectual property rights are transferred to the client as specified in the specific Project Statement of Work (SOW) or final contract.
3. Project Timelines & Deliverables
We strive to meet all estimated timelines for project milestones. However, software development involves dynamic challenges. Any estimated timelines provided are goals, not guarantees. We expect clients to provide prompt feedback and necessary resources to avoid delays.
4. Confidentiality (NDA)
We respect your business secrets. QubarTech agrees to keep all client data, proprietary systems, and business concepts strictly confidential. We are happy to sign custom Non-Disclosure Agreements (NDAs) prior to project commencement.
5. Limitation of Liability
In no event shall QubarTech, nor its directors, employees, partners, agents, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our software solutions post-deployment.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. We will notify active clients of substantial changes.
